Two lovers identified as Kenneth George and Evelyn Okechukwu, have been discharged and acquitted by an Ekiti State High Court sitting in Ado-Ekiti after being held in custody for four years on five counts bordering on robbery and conspiracy.

On Wednesday, November 12, 2014, Justice Isaac Akintayo held that after listening to the prosecution and defence witnesses, “no reasonable court or tribunal will convict them (accused persons).”

The justice whose verdict held that the accused persons be released  made the decision because there was no reasonable proof by the prosecuting counsel that they actually committed the crime.

He said, “I hold that the prosecution had failed to prove its case against the accused persons as required by Law.”

It was learnt that the state counsel, Mr. Gbenga Daramola, had earlier revealed to the court that the accused persons committed the offence on December 12, 2010 on Igbole Road, Ido-Ekiti.

According to the prosecutor, the offence contravened Section 1(2)(a) of the Robbery and Firearms (Special Provisons)Act, Cap R 11, Vol. 14, Laws of the Federation of Nigeria, 2004.

Contrarily, the defence counsel, Mr. Kola Kolade, held a different view and maintained that the accused be released as there was no proof beyond reasonable doubts that the crime was committed by the duo.
