A man was basking in the euphoria of oral sex which he felt was being performed on him by his girlfriend only to open his eyes to discover a gay stranger right on top of him.
The victim whose identity has not been disclosed for legal reasons was so disappointed and furious that he couldn’t help but burst into hot tears.
He told a court how he went to bed clad in his full cloth only for him to feel his trousers and underpants being removed by the stranger.
Thinking it was his girlfriend, the man allowed the person to continue touching his genitals and performing the sex act for a short while until he finally decided to open his eyes to behold the sight of a 22-year-old gay man named Dale Everard.
The victim reportedly jumped out of bed ‘in a state of shock and anger’ and burst into tears and pushed his attacker out into the street.
Dunfermline Sheriff Court heard how Everard rather told him ‘you liked it’
Earlier that evening, on May 10, 2014, the victim had been out with his girlfriend at the Brasshouse nightclub in Dunfermline, according to Metro UK.
The victim’s girlfriend who has also not been named, met Everard and became friends with him on the dance floor.
Everard of Boyle Drive, Rosyth, had told her he had been on a blind date that evening but he did not fancy the man.
Everard befriended the girlfriend on Facebook and spent most of the evening chatting and dancing with her.
The victim left the club around 2am saying he felt ‘drunk and had a headache’. His girlfriend followed shortly afterwards in a taxi, accompanied by Everard.
When they got to the flat, the victim had an argument with his girlfriend about her inviting a stranger back to their flat.
He fell asleep on top of his bed fully clothed and his girlfriend fell asleep on the sofa while the sexual assault happened shortly afterwards.
Everard, a first time offender, was jailed for 18 months on Monday, December 14, 2015 after admitting assaulting the man while he was asleep, under the influence of alcohol and incapable of giving or withholding consent. He has also been put on the sex offenders register.
Sentencing, Sheriff Craig McSherry told the court: “This was a serious offence carried out with considerable forethought. You befriended the victim’s girlfriend, went back to the flat with her, entered the bedroom and carried out the sexual assault.”
The defence solicitor of the accused, Stephen Morrison expressed his disappointment, adding that he was ‘ashamed’ and appalled’ by his actions.
