3 Rapists Sentenced To Death Under India’s New Rape Law (PICTURED)

A sessions court on Friday awarded death penalty to three convicts in the gangrape case of a 23-year old photo journalist inside Shakti mills on August 22, 2013.

Three convicts- Vijay Jadhav (18), Mohammad Qasim Shaikh (20) and Salim Ansari, were awarded death penalty for being repeat offenders under section 376E of the Indian Penal Code. This is the first time that any court has applied the section since the amendment made in February last year.

The trio on July 31, 2013 had participated in a gangrape of another 19- year-old telephone operator inside the Shakti mills. The court has held them guilty in that case, too, and have sentenced them to life term on March 20. The life term is to continue until the remainder of their natural life as prescribed under section 376D of the Indian Penal Code.

The court on Thursday accepted the prosecution’s case that the accused had committed two gangrapes on a previous (July 31, 2013) and subsequent date (August 22, 2013) and convicted them under the amended section 376E of the Indian Penal Code (IPC) for repeating the same offence. The section attracts a minimum of life sentence until death and the maximum punishment prescribed under the section is death. The court on Thuraday said this “enhanced section is not only to convict a repeat offender but should also send out a strong message to the like- minded people of the society.”

The photo journalist was gangraped by five men including a minor. While the minor is facing trial before the Juvenile Justice Board, Siraj Rehman, another convict in the case was awarded life sentence, until the remainder of his natural life.

The woman was gangraped inside a decrepit Mills when she had gone for a photo assignment with her male colleague. The woman and her colleague had identified the accused in the court.
