Actor Tracy Morgan Sues Walmart Over Fatal Car Accident

Tracy Morgan has taken action against Walmart, accusing the chain of super stores of being partially responsible in the car accident that left him severely injured.

According to the NY Post, Morgan’s new lawsuit claims that Walmart allowed one of its drivers to operate his truck at an unacceptable level of exhaustion. Morgan, along with three other plaintiffs, is seeking an unspecified amount of damages.

The suit was filed in New Jersey, the location of the accident, and also alleges that the company allowed Kevin Roper to take on a 10-hour drive after being awake for more than 24 hours. It also asserts that Tracy sustained, “severe painful bodily injuries, including but not limited to multiple fractures which required multiple surgeries, extensive medical treatment and will require significant physical rehabilitation.”

Morgan was released from the hospital last month, but remains in treatment at a physical rehabilitation center.

Roper had reportedly driven an astonishing 700 miles from his home to the Walmart distribution center before even beginning the drive that killed James ‘Jimmy Mack’ McNair and injured Morgan along two others.

Roper stands charged of death by auto and has pled not guilty to those charges.

Walmart has spoken to TMZ, saying in a statement, “As we’ve said, we’re cooperating fully in the ongoing investigation. We know it will take some time to resolve all of the remaining issues as a result of the accident, but we’re committed to doing the right thing for all involved.”

**UPDATE**

Shortly after his post was published, a representative for Tracy released a statement confirming the lawsuit and announcing that he’s finally headed home.

Tracy has been released from the rehabilitation center and will continue his recovery efforts at home with an aggressive outpatient program.  He asked me to pass along his sincerest gratitude to everyone who has helped him get to this point.  He would also appreciate some privacy during this crucial point in his recovery.In regards to the reports of a lawsuit, I can confirm that Tracy, along with the other victims of this horrific accident, have filed suit.
