Absence Of Case File Stalls Nnamdi Kanu’s Appeal

The Court of Appeal sitting in Abuja has, again, adjourned the appeal filed by Nnamdi Kanu. The court sat on Monday, April 25, 2016 and adjourned the case to Thursday, May 5, 2016.

The adjournment was sequel to the unavailability of Kanu’s file in the court for the hearing.

Kanu is being tried alongside 2 others, David Nwawusi and Benjamin Madubugwu on charges bordering on treasonable felony, unlawful possession of firearms and the management of an unlawful society.

Kanu’s counsel, Chuks Muoma, had expressed to the court, his disappointment at discovering that the case was not due for hearing even though it was fixed for Monday, April 25, by the same court.

Kanu had approached the appellate court for an order to direct the Chief Judge of the Federal High Court, Justice Ibrahim Auta to take Justice Tosho off the trial and assign another judge.

Kanu accused Justice Tosho of bias after the judge ruled that witnesses in the trial would be allowed to testify behind a shield thereby hiding the witnesses’ identity from the members of the public.
