The Court of Appeal sitting in Abuja on Thursday, January 24, 2019, set aside the December 14, 2018, Judgement of the FCT High Court which upturned the election of Donald Duke as the presidential candidate of the SDP at its national convention of October 6, 2018, and declared Professor Jerry Gana instead.

In a unanimous judgement of the learned trial justices of the Court of Appeal presided over by Justice Adamu Jauro,  ruled in favour of Donald Duke as the SDP presidential candidate.

The Court said that there is no where in the constitution that says an aspirant from certain states can not aspire to be the president of Nigeria.

It also ruled that if there is anyone to be declare winner, that person must be the one that the people voted for at the Party National Convention.

The court therefore set aside the Judgement of the Abuja High Court and declared Mr. Donald Duke as the SDP presidential candidate for the February 16, 2019, Presidential election.
